Welcome to ExamShala. By accessing or using our website, mobile applications, and related services (collectively, the 'Services'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree, please refrain from using our Services.

By accessing or using our Services, you confirm that:

• You have read, understood, and agree to be bound by these Terms;
• You are at least 13 years of age or, if under 13, you have the permission of a parent or guardian to use the Services in accordance with these Terms;
• If you are agreeing to these Terms on behalf of an organization or entity, you have the authority to bind that organization or entity to these Terms.

These Terms constitute a legal agreement between you and ExamShala, governing your access to and use of the Services.

ExamShala provides an educational platform that offers various services, including but not limited to:

• Mock tests and practice exams for various competitive examinations;
• Study materials, notes, and educational resources;
• Live classes and recorded video lessons;
• Performance analytics and progress tracking;
• Mentorship and doubt-solving sessions;
• Educational content in multiple languages.

ExamShala reserves the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

To access certain features of our Services, you may need to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information;
• Maintain and promptly update your account information;
• Maintain the security of your account and password;
• Accept responsibility for all activities that occur under your account;
• Notify ExamShala immediately of any unauthorized use of your account.

ExamShala will not be liable for any loss or damage arising from your failure to comply with these obligations.

You may not share your account credentials with others or allow multiple users to use your account. Each user must create and use their own account.

While some of our Services are offered free of charge, certain features, content, or services may require payment of fees. By choosing to use such services, you agree to pay all applicable fees:

• All fees are stated in Indian Rupees (INR) unless otherwise specified;
• Payments can be made through the available payment methods on our platform;
• ExamShala reserves the right to change the fees for any Services with reasonable notice;
• Subscription-based services will automatically renew unless canceled according to our cancellation policy;
• Refunds, if applicable, will be processed according to our Refund Policy.

You agree to provide current, complete, and accurate purchase and account information for all purchases made through our Services.

Subscriptions to our paid Services may be canceled at any time through your account settings or by contacting our support team:

• Cancellation will be effective at the end of your current billing period;
• No refunds will be provided for partial subscription periods unless required by law;
• For one-time purchases (such as specific courses or test series):
  • Refunds may be requested within 7 days of purchase if you have not accessed more than 25% of the content;
  • Refund requests must be submitted in writing to support@examshala.in;
  • All refunds are subject to review and approval by our team.

ExamShala reserves the right to deny refund requests that do not comply with these conditions.

You agree not to engage in any of the following prohibited activities:

• Copying, distributing, or disclosing any part of the Services in any medium;
• Using any automated system, including 'robots,' 'spiders,' or 'offline readers,' to access the Services;
• Attempting to interfere with, compromise the system integrity, or decipher any transmissions to or from the servers running the Services;
• Uploading invalid data, viruses, worms, or other harmful software;
• Impersonating another person or otherwise misrepresenting your affiliation;
• Collecting or harvesting any personally identifiable information from the Services;
• Using the Services for any commercial solicitation purposes without our prior written consent;
• Sharing answers or engaging in any form of cheating;
• Violating any applicable laws or regulations.

ExamShala reserves the right to terminate your access to the Services immediately, without prior notice, if we determine that you have violated these Terms.

The Services and their content, features, and functionality are owned by ExamShala and its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws:

• You may not use, reproduce, distribute, modify, create derivative works of, publicly display, or perform any copyrighted material from our Services without prior written consent;
• ExamShala's name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ExamShala or its affiliates or licensors;
• You retain ownership of any content you submit, post, or display on or through the Services, but you grant ExamShala a worldwide, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content;
• You agree that this license includes the right for ExamShala to make your content available to other users of the Services, who may also use your content subject to these Terms.

By submitting any content to ExamShala, you represent and warrant that you have all necessary rights to grant these licenses.

The Services are provided on an 'as is' and 'as available' basis without any warranties of any kind, either express or implied:

• ExamShala does not warrant that the Services will be uninterrupted, error-free, or completely secure;
• ExamShala disclaims all warranties regarding the accuracy, reliability, completeness, or timeliness of the content, services, software, text, graphics, links, or communications provided on or through the use of the Services;
• To the maximum extent permitted by applicable law, ExamShala shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly;
• In no event shall ExamShala's total liability to you for all damages, losses, or causes of action exceed the amount you have paid to ExamShala in the last three (3) months, or INR 1,000, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless ExamShala, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

• Your access to or use of the Services;
• Your violation of these Terms;
• Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right;
• Any content you upload, post, email, transmit, or otherwise make available through the Services.

This defense and indemnification obligation will survive these Terms and your use of the Services.

These Terms and any disputes arising out of or related to these Terms or the Services shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall first be attempted to be resolved through good-faith negotiations between the parties. If such dispute cannot be settled amicably within thirty (30) days, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India.

The arbitration shall be conducted by a sole arbitrator appointed by ExamShala. The place of arbitration shall be Bihar, India, and the language of the arbitration shall be English.

ExamShala reserves the right to modify these Terms at any time. We will provide notice of any material changes by updating the 'Last Updated' date at the top of these Terms and/or by sending you an email or providing a notification through our Services.

Your continued use of the Services after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide and be bound by the modified Terms.

If you do not agree to the modified Terms, you must stop using the Services.

• Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced;
• Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without ExamShala's prior written consent. Any attempt to do so will be null and void. ExamShala may assign these Terms without restriction;
• Entire Agreement: These Terms constitute the entire agreement between you and ExamShala regarding the use of the Services, superseding any prior agreements between you and ExamShala relating to your use of the Services;
• Waiver: The failure of ExamShala to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision;
• Force Majeure: ExamShala shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond ExamShala's reasonable control.
